The CSRA Partner Group existed years before Phantom Cow, and is committed to finding/supporting a closure to the "Hoyt Partnership Investment Fiasco" following Rule of Law. The Hoyt Investor will not know his tax liabilities (if any) until the final partnership return has been filed. The Department of Justice (Bankruptcy Court) will be the major player in the final return. Mr. Cobb, a new TMP, and the attorneys being networked will be involved.

The Partnership Level Attorney, with the expertise of 20+ Tax Attorneys networked by partners, is determined to end this sad story of misconduct by both IRS and TMP.   Supporting the PDFT and writing to your congressional leaders/TAOs is an effective way to help bring closure. CSRA Partner Group Policy

Mission
The CSRA (Central Savannah River Area / and surrounding states) Partner Group mission is to support closure of Hoyt Partnership Investments in the best interests of Investors abiding by rule of Law.

It is the position of the CSRA Partner Group that IRS failed to perform their duties mandated by Congress in the best interest of US Government. (Transpac v. Commissioner, 2nd Circuit Court of Appeals).

Scope
PDFT (see What is the PDFT?)
To support the Partnership Level Attorney, Montgomery Cobb, via PDFT  in final closure of remaining partnerships items.

CSRA Partner Group
To conduct periodic meetings of CSRA Partner Group following "Roberts Rule of Order" informing investors of items related to the Hoyt Partnership Investment closure.

CSRA Partner Group Attorney Program
To adequately fund the CSRA Group Attorney Program to perform "Statement of Work" voted by majority participating in the CSRA Group Attorney Program during each monthly meeting. See Sections Responsibilities of CSRA Partner Group Representative and General Information (motions amp voting) for additional information.

 

Responsibilities, Terms and Definitions
Attorney (Group Program)
Legal counsel hired by contributing partners of a partner group for purpose of legal advice at shared cost. General duties of the CSRA Group Attorney are to maintain communications with the Partnership Level Attorney, other Group / Individual Investor Attorneys (20+) located throughout the nation. The CSRA Group Attorney will stay informed of strategies and matters of law networked with other Attorneys to provide best defense possible for each individual at time of need. Treasurer shall provide the Group Attorney the names and addresses of the contributing partners.

Attorney (Individual)
Legal counsel for partner of emergent need. Group attorney should be considered for individual due to gained knowledge via Group Attorney Program.

Attorney (Partnership Level)
Legal counsel at the partnership level. Provides legal advice/defense relating to partnership closure activities.

CSRA Partner Group
Partners within South Carolina, Georgia and surrounding states sharing information and expenses relating to W.J. Hoyt Partnerships. Any partner or ex-partner shall be permitted to attend group meetings.

CSRA Partner Group Address Book
Mailing and e-mail Listing maintained by member of the CSRA Partner Group. Holder of address book will issue meeting notices, 1-2 weeks before meeting date.

CSRA Partner Group Correspondence Form
Used to facilitate communication to the CSRA partner group.

CSRA Partner Group Mail Clerks
Points of contact for investors outside the CSRA Partner Group. Mail Clerks to forward all contacts with name, address, phone number (e-mail address if available) and purpose of contact to CSRA Partner Group Postman. See Policy General Section "Non CSRA Partner receiving information from CSRA Partner Group" for additional information.

CSRA Partner Group Postman
Points of contact for CSRA Partner Group Clerks. Postman to review nature of request and forward to most appropriate members for resolution. Postman will generate handouts for each CSRA Partner Group Meeting and forward to next meeting Chairman for review.

Partner, Group Chairperson
Facilitator of group meeting. Partner of group selected by group to conduct group meeting in a discipline manner. Chairperson selection shall be first business of meeting. The next meeting Chairperson shall be responsible for recording minutes and votes. See General Information (Group Meeting) for additional information.

Partner, Group Congressional Coordinator
(Including other activities such as TAOs)
Partner of a Partner Group tasked to coordinate letters prepared by Group Attorney’s for Congressional Offices. The purpose of the Congressional Coordinator is to prevent a duplication of information being sent to the Congressional Offices. The Congressional Coordinator will gather copies of personal partner letters having been mailed, all attachments being provided by networked attorneys and file for future use. The CSRA Congressional Coordinator will also assist in the coordination of congressional office meetings. The Congressional Coordinator will inform the CSRA Partner Group Postman of all congressional contacts.

Partner, Group Representative
Partner contributing to the Group Attorney Program. Partner communicates with group partners, prepares "Statement of Work" and funnels information/questions to group attorney. Point of contact for group to keep legal expenses to a minimum. However, any participant of the CSRA Partner Group Attorney Program obtaining information relevant to the mission of this policy and unable to contact the CSRA Partner Group Representative for 72 hours upon receiving information shall immediately forward information to the CSRA Partner Group Attorney.

Partner, Group Secretary
Individual attending Group Meeting--assigned by Chairperson to record approved motions. Group Secretary shall use the CSRA Partner Group Correspondence Form to record approved motions and forward to Partner Group Treasurer at close of meeting.

Partner, Group Treasurer
Selected Group Partner that maintains funds to support activities of the Partner Group. Group Treasurer shall inform Group Attorney names of partners contributing to the Group Attorney Program. Group Treasurer shall pay group attorney from partner group account for work performed. Group Treasurer will coordinate with Group Representative of additional funding requirements. Treasurer will inform chairperson of any additional funding requirements and submit funding proposals based on group size during group meeting.

Partnership Defense Fund Trust (PDFT)
Monies placed into a Trust Fund to support activities related to Hoyt Investment Closure. Funds to maintain legal counsel (Montgomery Cobb), CPAs, supporting personnel (Blackburns) at the partnership level. PDFT is not used to support investment continuation.

General Information
Group Meeting
CSRA Partner Group meeting will follow "Roberts Rule of Order to facilitate updates from Group Attorney, investor shared information, path-forward strategies and development of Group Attorney "Statement of Work". Committees may be assigned by meeting chairperson to perform research of questionable items or development of specific strategy. Chairperson at anytime during the meeting may dismiss any attendee of meeting for being disrespectful of Roberts Rule of Order.

* Assignment of Next Meeting Chairperson (See General Information).
* Assignment of meeting Secretary (See Terms and Definitions)
* Inform Group Location of Attendance Sheet
* Inform Group of Restroom Locations
* Discuss next Meeting Date, Location and Time.
* Call upon Treasurer for report of Expense, Income and Current Balance
* Reading of last meeting minutes by Chairperson.
* Open Old Business of meeting (Information Sharing/Motions/Discussions/Vote).
* Close Old Business of meeting.
* Close old Business of meeting.
* Open New Business of meeting (Information Sharing/Motions/Discussions/Vote).
* Close New Business of meeting.
* Transfer of Records per Policy of CSRA Partner Group.
* Declare meeting is over.

Motions and Voting
All attendees of CSRA Partner Group may introduce motions followed by discussions. After discussions, any attendee of meeting may second the motion. Afterwards, the motion will be placed before attendees for approval by majority vote. However, votes relating to Statement of Work for CSRA Group Attorney will only be accepted using the following:

 
1. Must be participating in the CSRA Partner Group Attorney Program
2. Weight of vote:

  • Partner 10-25% of account weight of .25
  • Partner 26-50% of account weight of .5
  • Partner 51-75% of account weight of .75
  • Partner 76% or greater of account weight of 1

Next person taking minutes will be responsible for recording votes on attendance roster. Attendance roster will be given to CSRA Group Treasurer for weight determination and verified by CSRA Partner Group Representative. Upon verification of vote, the CSRA Partner Group Representative will prepare Statement of Work and forward to CSRA Partner Group Attorney.

Joining the CSRA Partner Group Attorney Program
$200.00 catch-up fee and voted next meeting funding requirements is required to become a member of the CSRA Partner Group Attorney Program.
However, there is no assurance that the CSRA Group Attorney can represent the investor as an individual due to a conflict of interest. The CSRA Group Attorney will determine if a conflict of interest may exist.

Non CSRA Partner receiving information from CSRA Partner Group
It is the policy of the CSRA Partner Group that individuals receiving information from the CSRA Partner Group be listed as point of contact for individuals having similar request within their region. Cost relating to reproduction and mailing will be the responsibility of requester. Requester will be contacted by member of CSRA Partner Group for details of payment and mailing. Networking is key to minimizing expenses.
